1. Agreement to Terms

By downloading, installing, or using Bhansa ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Bhansa is a meal planning application that provides:

• Personalized recipe recommendations based on your preferences
• Pantry management and ingredient tracking
• AI-powered meal plan generation
• Shopping list creation
• Recipe saving and organization

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account using:

• Google Sign-In, or
• Apple Sign-In

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete information

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse the service or other users

4. User Content

4.1 Your Content

You retain ownership of content you create, including:

• Recipe modifications and notes
• Pantry items and quantities
• Meal plans and shopping lists
• Ratings and feedback

4.2 License to Us

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store and display your content to you
• Use anonymized, aggregated data to improve the service
• Process your content through AI services for recommendations

4.3 Content Guidelines

You agree not to submit content that:

• Infringes on intellectual property rights
• Contains harmful, offensive, or illegal material
• Violates the privacy of others
• Contains malware or harmful code

5. AI-Generated Content

5.1 Recipe Recommendations

The App uses artificial intelligence (OpenAI) to generate recipe recommendations. You acknowledge that:

• AI-generated recipes are suggestions only and may contain errors
• You should independently verify all ingredients before preparing or consuming any recipe
• Results may vary based on actual ingredients, brands, and cooking methods
• AI recommendations are not a substitute for professional culinary or dietary guidance

5.2 Nutrition Estimates and Health Grades

All nutritional information displayed in the App -- including calories, macronutrients (protein, carbohydrates, fat), micronutrients (fiber, sugar, sodium), and health grades (A through E) -- is AI-generated by OpenAI and calculated using an algorithm based on the publicly available Nutri-Score system (Sante Publique France). You acknowledge that:

• Nutritional values are estimates only and are not sourced from a certified nutritional database
• Actual nutritional values may vary significantly based on specific ingredient brands, portion sizes, and preparation methods
• Health grades are algorithmic assessments, not medical evaluations
• This information is provided for general reference only and should not be used to make medical or dietary decisions
• You should consult a qualified healthcare professional or registered dietitian for personalized nutritional advice

5.3 Allergy and Dietary Restriction Limitations

The App allows you to specify allergies and dietary restrictions to filter recipe recommendations. You acknowledge that:

• Allergy filtering is performed by AI and is not guaranteed to be complete or accurate
• AI may fail to identify all allergens, cross-contamination risks, or ingredient derivatives
• You are solely responsible for verifying that all ingredients in any recipe are safe for you to consume
• The App does not replace professional medical advice for managing food allergies or intolerances
• If you have severe or life-threatening food allergies, you must independently verify every ingredient before consuming any recipe suggested by the App

5.4 No Medical Advice

The App does not provide medical, nutritional, or dietary advice. The nutrition information, health grades, and dietary filtering provided are for informational purposes only. Always consult a healthcare professional for:

• Severe food allergies or anaphylaxis risk
• Medical dietary restrictions
• Nutritional deficiencies or specific dietary needs
• Eating disorders or related conditions
• Any health condition that requires dietary management

5.5 Food Safety

You are responsible for:

• Proper food handling and storage
• Checking expiration dates
• Following safe cooking practices
• Verifying ingredient freshness

6. Intellectual Property

6.1 Our Property

The App and its original content, features, and functionality are owned by Bhansa and are protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

6.2 Third-Party Content

Some recipes and content may be sourced from third parties. Such content remains the property of its respective owners.

6.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use the App for commercial purposes without permission
• Scrape or extract data from the App

7. Subscription and Payments

7.1 Free Features

Basic features of the App are available for free, including limited recipe suggestions, pantry management, and shopping lists.

7.2 Premium Subscription

The App offers optional premium subscriptions (monthly and yearly) that unlock additional features such as unlimited recipe generation, advanced meal planning, and full cooking assistance. By subscribing:

• Pricing is clearly displayed before purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment is charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase
• You can manage or cancel subscriptions in your device settings (iOS: Settings > [your name] > Subscriptions; Android: Google Play > Subscriptions)
• Refunds are subject to Apple App Store or Google Play Store policies
• We reserve the right to modify pricing with reasonable notice; existing subscribers will be notified before any price change takes effect

8. Disclaimers

8.1 "As Is" Basis

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including: merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.

8.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Results will be accurate or reliable
• Defects will be corrected
• The App is free of viruses or harmful components

8.3 Third-Party Services

We are not responsible for:

• Third-party authentication services (Google, Apple)
• AI service providers (OpenAI)
• External websites or content linked from the App

9. Limitation of Liability

9.1 No Liability for Damages

To the maximum extent permitted by law, Bhansa shall not be liable for: indirect, incidental, special, or consequential damages; loss of profits, data, or goodwill; personal injury or property damage; any damages arising from use or inability to use the App, AI-generated content or recommendations, unauthorized access to your data, or third-party conduct or content.

9.2 Maximum Liability

Our total liability shall not exceed the amount you paid to us in the past twelve (12) months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Bhansa and its affiliates from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the App

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

12. Modifications to Service

We reserve the right to:

• Modify or discontinue features without notice
• Update the App to improve functionality
• Change pricing for premium features with notice
• Limit availability in certain regions

13. Changes to Terms

We may update these Terms at any time. Changes will be effective when posted. Your continued use after changes constitutes acceptance of the new Terms.

We will notify you of significant changes through:

• In-app notifications
• Email (if provided)
• App update notes

14. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

15.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

15.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bhansa regarding the App.

If you download the App from the Apple App Store:

• These Terms are between you and Bhansa, not Apple

20. Google Play Store Additional Terms

If you download the App from Google Play:

• These Terms are between you and Bhansa, not Google
• Google has no obligation to provide support
• Google is not responsible for any claims relating to the App
